Maybe no one thinks I’m serious, but I am willing to blindly give bob 1800 and buy an aero from omar for 1800.

I can wait a year if you want, and if that 1800 shows up in omar’s account he can pay me back then.

But if Bob would like to wait a few weeks and see if a cab shows up, then cheers.

It's not that no one thinks you're serious, or really nice for offering... but I think folks are trying to simplify the problem to a resolution, and adding more counterparties adds additional risk and defers the pressure for resolution to a later date.

You're awesome for offering to help and take on that risk, but I don't think it should be necessary. :thumbup:
 
It seems to be that Omar is genuinely confused.

From what has been mentioned the $1800 has already been refunded to Omar and the debt (charge back) to PayPal has been settled but Omar still has Tony's $1800. I'm not sure why he believes a refund will be initiated in the next 11 days.

This involved 2 phone calls with PayPal. During the first phone call, the agent told me that Omar does not have a negative paypal balance which he already showed us in his screenshot. She then said let me look into this further and call you back.

When she called me back, her tune changed completely and she told me that she could not release any further details about another members account, and advised me that if Omar was confused about whether he received a refund or not, that he should call PayPal directly with any questions.

Wow this reminded me of a charge back I had with a good friend.

synopsis of how it went down
Friend gets pinball deal ( 1:1 passing the deal sideways) and stuff from other vendors in that month.

Two months later and he thinks a vendor double charged him so my payment was pulled back from PayPal.

Buyer contacted his bank and they returned money back to PP. Pp can't return the money as CC has 180 days to pull it back again.

I just left my account in negative the whole time and a week prior to end of 180 days after the dispute they sent me to collections. Loads of time wasted on it and collections was resolved with call #9992 to paypal for the issue.

Buddy and I are cool and it was the principal of the matter in the end not to show any negative strikes on my merchant account or have ether of us paying a fee or %.

Looks like something similar happened between Omar and buyer once the cc was charged back. Lucky it seems paypal is easier to deal with this now vs when I had the issue 3 years ago.

Honestly I find the entire thing utterly bizarre. All around. Nobody looks good, and it all seems so unnecessary.

Others can disagree, but to me if you arrange a restoration buy with someone, and they say it's going to take 3 months, and you still send the money anyways knowing that fact, that money is gone. You understood the timeline, you paid up front, it's not your money anymore unless they fail to deliver the cab at the end of at least the 3 months. You can't just ask for it back a month in, that ship sailed.

If you want your money back you need to wait until the cab is done, and then sell it. It's only $1800 bucks, you aren't owed like daily updates or anything. It's just not that much money, send it and wait. If you're an impatient buyer or you get cold feet or you just have restless leg syndrome cool, don't pay up front for restorations. That's always your choice.

Secondly, it's weird as hell that Tony filed a chargeback with his credit card company or a PayPal dispute or whatever he did, and then, knowing he did that, took his friend's money anyway. Why would you do that?

Bob got put in this awkward ass position by his own friend, assuming the timeline we've been given is accurate. Like, all other details aside, whatever 'Omar' should have done, that seems like a pretty clear fact and I don't get how you even do that. Resolve the money issue before you take your friend's. That means cancel the chargeback and make sure it's done first, or get the money back free and clear, whatever, don't create drama for someone else.

And again, a chargeback should be reserved for someone ripping you off. You were a third or so into the wait, you weren't ripped off. You were just impatient. That's not someone else's problem. Disputing a charge when the other party didn't break their side of the agreement is bad juju.

On top of all that weirdness—and again you might not agree with how I think the money is spent, and you're not owed a refund mid-process—it's $1800. FFS Horacio, just send the money back, even if it's stupid, and sell the cab to someone else. We all know if you offered up a restored Aero in SoCal for that much that you'd have a buyer within a day. Why invite all this BS on your rep over it? Tony shouldn't have asked for the money back, but you could have given it to him anyways to not have the headache and never dealt with him again.

Who has the money or what the balance is or what PayPal did or did not reveal over the phone or who's telling the truth I have no idea. You all look silly now, and it never needed to be like this.
 
At this point, i would go to the police and call my legal insurance to make the next step.

That’s excessive…$1800 might be a lot of money for some but the trouble that you would be going through with the above recommendation exceeds the cost..$1800 is nothing.
 
@Aurich at the end of the day, regardless how it went down is irrelevant now.

Horacio has the cab & the $1800 and basically gave all parties involved the finger when it came time to do the right thing. It took the community’s support and an entire day of posts here to try to convince him to do the right thing. No refunds have been issued thus far.
 
In case anyone needs clarification on what Omar is talking about..

When I was a young kid I watched my mom die in front of me. It has caused me a lifetime of severe anxiety. I do go to therapy and take medication to help.

Omar you are a total POS for pestering me about this.
Yeah that is 100 percent a scumbag move.

It is typical of people in the wrong to openly question the mental health of someone they are arguing agains once they have nothing of substance to argue.

I hope Omar returns the money but this 100 percent permanently ruined his reputation with me, based on his behavior alone.

Not in germany, its one call with the legal insurance and they cover it.
Had two cases in the last 10 years and they did almost all of the work and no extras or hidden costs.
Thats why its called insurance :)

I can agree with this in a real world business sense.

Cause if this was a normal business deal for work from a contractor or say Car Restoration business. Most require money up front for materials, a agreed upon quote, and lead time / ETA. All via a written agreement. The quote being a quote and not final cost and ETA being a estimate not an exact date.

If this were the real world business sense. Tony would be 100% in the wrong and likely taken to small claims court. Or say a Car, the vehicle can be withheld if the owner refuses to pay, or with a house renov or addition a lien put on the property deed. Far more impact than 1800 and a cab not of initial ownership.

In this "Gentleman's agreement". Tony did completely waste his time. An argument can even be said that Tony doesn't even deserve a refund in full.

I'll say it again. Bob is the priority and needs to be taken care of first. He tried to help a friend and his friend should admit his mistake and do the right thing. The community help/input and reputations of Tony and arcade game can work doing the right thing with a resolution on their agreement. Mental Health really shouldn't be part of the discussion, its personal and unprofessional to attack someone with it.
 
If I hired a contractor to build me a house, and during the entire process the contractor is not keeping his word and acting flakey, which makes me question the deal entirely.

So I tell a friend, hey man I want out of this house, and my friend says hey man i'm looking for this exact same house, i'll buy it from you and deal with the contractor.

Regardless the situation, when the house is finally built, the contractor owes someone the house, or a refund no?

Isn't it fucked up when the contractor says, fuck you both i'm keeping the house AND your money?
